    • These Terms and Conditions govern your use of the Tesco Phone Shop website, the Tesco Phone Shop Telesales team and your relationship with Tesco Stores Limited trading as Tesco Phone Shop (Tesco, we or us).

      Please read these Product Terms & Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes items available to you via Tesco Phone Shop. Please note these Product Terms and Conditions will not apply in the Republic of Ireland as purchases within the Republic of Ireland may only be made via the ROI website.       If you do not agree to these Terms and Conditions, please do not register for or use the Tesco Phone Shop – Pay Monthly Site.

  • Use of the Tesco Phone Shop - Pay Monthly Site
    • The Tesco Phone Shop – Pay Monthly Site and Tesco Phone Shop – Telesales Team are provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Tesco Phone Shop – Pay Monthly Site you agree to be bound by these Terms and Conditions.

      These Terms and Conditions govern your use of the Tesco Phone Shop – Pay Monthly Site, online store, Tesco Phone Shop Telesales Team and all services provided in connection with these.

      All orders and purchases made on the Tesco Phone Shop – Pay Monthly site and through the Tesco Phone Shop Telesales Team will also be governed by the specific Product Terms & Conditions (Product Terms) relevant to the online store.

      THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

  • Amendments
    • We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the online store. Any changes will be notified to you via a suitable announcement on the Tesco Phone Shop – Pay Monthly Site. The changes will apply to the use of the Tesco Phone Shop – Pay Monthly Site and Tesco Phone Shop Telesales Team after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Tesco Phone Shop – Pay Monthly Site, the online store or the Tesco Phone Shop Telesales Team.

  • Clubcard, vouchers and coupons

    • This paragraph on Clubcard is in addition to the terms and conditions of Tesco Clubcard.

      To be awarded Clubcard points applicable to purchases on the Tesco Phone Shop – Pay Monthly Site and through the Tesco Phone Shop Telesales Team you need to have a valid Tesco Clubcard or a Tesco e-Clubcard number that you must enter when requested on the Tesco Phone Shop – Pay Monthly Site.

      Provided that the relevant purchased items have not been returned the points will be added to your Clubcard after your phone has been active for three months.

      All promotional points exclusive to sales over the Internet, will be added after your phone has been active for more than three months. Members can earn a maximum of 30,000 points in any one collection period.
      Clubcard points received for the purchase of a refunded item may be removed from your Clubcard account.

      The following items cannot be redeemed against purchases on the Tesco Phone Shop – Pay Monthly Site or through the Tesco Phone Shop Telesales Team: (a) paper Clubcard Vouchers, electronic Clubcard eVouchers (which are issued for use on Tesco.com), (b) bonus coupons (which may be received with the quarterly Clubcard mailing, by email, awarded online or handed out in a Tesco retail store), and (C) product or discount coupons issued by manufacturers or promoters.

  • Cashback
    • Cashback is only available on certain contracts and is subject to a minimum period of line rental. All cash back is sent by cheque. For more information please see Product Terms and Conditions.

  • Tesco eCoupons
    • Tesco Phone Shop may issue its own eCoupons directly or via Tesco channels or third parties.

      This section sets out the terms and conditions for eCoupons. eCoupons are redeemable at the checkout page when making a purchase from the Tesco Phone Shop – Pay Monthly Site. eCoupons can only be used on the Tesco Phone Shop – Pay Monthly Site and are not redeemable through the Tesco Phone Shop Telesales Team, on Tesco.com, through Tesco Stores Limited or Tesco Personal Finance.

      We are entitled to cancel and reissue any eCoupons and to suspend or change any aspects of the operation of eCoupons at our reasonable discretion.

      A. Using eCoupons

      An eCoupon can only be used either as part payment for the item(s) stated on the eCoupon or in conjunction with the minimum spend threshold stated on the coupon in a single transaction.

      If we reasonably believe that there is a breach of security or fraudulent use of eCoupons, we may reject any eCoupon.

      Once you have used an eCoupon once, you cannot use it again. eCoupons may require a valid associated Clubcard number or email address to be given.

      B. Restrictions on using eCoupons

      You cannot use an eCoupon against the delivery charge or the postage & packaging of an order. Unless we tell you otherwise on the eCoupon, eCoupons cannot be used in conjunction with other offers.

      eCoupons cannot be exchanged for cash or gift vouchers.

  • Refunds on promotional offers

    • Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price paid. Your statutory rights are not affected.

  • Excluded services
    • The services provided by the Tesco Phone Shop – Pay Monthly Site do not include the provision of computer or other necessary equipment to access the Tesco Phone Shop – Pay Monthly Site. To use the Tesco Phone Shop – Pay Monthly Site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

  • Intellectual property
    • The content of the Tesco Phone Shop – Pay Monthly Site and Tesco Phone Sop Telesales Team is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Tesco Phone Shop – Pay Monthly Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Tesco Phone Shop – Pay Monthly site or from the Tesco Phone Shop Telesales Team without written permission from Tesco Phone Shop.

      No licence is granted to you in these Terms and Conditions to use any trade mark of Tesco or its affiliated companies including, without limitation, the trade marks TESCO, Tesco Phone Shop and TESCO CLUBCARD.

  • Your use of the Tesco Phone Shop - Pay Monthly Site

    • You may not use the Tesco Phone Shop – Pay Monthly Site or Tesco Phone Shop Telesales Team for any of the following purposes:

      • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.

      • Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice gaining unauthorised access to other computer systems.

      • Interfering with any other person's use or enjoyment of the Tesco Phone Shop – Pay Monthly Site or the Tesco Phone Shop Telesales Team.

      • Breaching any laws concerning the use of public telecommunications networks.

      • Interfering or disrupting networks or web sites connected to the Tesco Phone Shop – Pay Monthly site.

      • Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

      You will be responsible for our losses and costs resulting from your breach of this section 9.
      Tesco Phone Shop reserves the right to refuse to post material on the Tesco Phone Shop – Pay Monthly Site or to remove material already posted on the Tesco Phone Shop – Pay Monthly site.

  • Availability of the Tesco Phone Shop - Pay Monthly site
    • Although Tesco Phone Shop aims to offer you the best service possible, Tesco Phone Shop makes no promise that the services at the Tesco Phone Shop – Pay Monthly Site or Tesco Phone Shop Telesales Team will meet your requirements. Tesco Phone Shop cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to paymonthlycare@tescophoneshop.com and we will attempt to correct the fault as soon as we reasonably can.

      Your access to the Tesco Phone Shop – Pay Monthly Site and Tesco Phone Shop Telesales Team may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Tesco Phone Shop will attempt to restore the service as soon as it reasonably can.

  • Tesco Phone Shop' liability
    • If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result and to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order.

      Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

      This section 11 shall not limit or affect our liability resulting from any products sold through the Tesco Phone Shop – Pay Monthly Site or Tesco Phone Shop Telesales Team being found to be unsafe or if something we do negligently causes death or personal injury.

      The Tesco Phone Shop – Pay Monthly Site provides content from other Internet sites or resources and while Tesco Phone Shop tries to ensure that material included on the Tesco Phone Shop – Pay Monthly Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If Tesco Phone Shop is informed of any inaccuracies in the material on the Tesco Phone Shop – Pay Monthly Site we will attempt to correct the inaccuracies as soon as we reasonably can.

  • Advertising and Sponsorship

Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Tesco Phone Shop – Pay Monthly Site and Tesco Phone Shop Telesales Team complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

  • Applicable law
    • We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with you in any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

  • International use

  • Expiry date on payment card
    • Please ensure that the expiry date of your payment card is after the anticipated despatch date on your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.

  • Miscellaneous
    • You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.

      If you breach these Terms and Conditions and Tesco Phone Shop chooses to ignore this, Tesco Phone Shop will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

      Tesco Phone Shop shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
